Woman Receives Compensation for Glass in Food Without Admission of Liability

A woman has received compensation for an injury she sustained after finding glass in her Dunnes Stores pork chop without the supermarket chain admitting liability. 

In September 2013, Amy Holden of Ballybrack, County Dublin, was eating a marinated pork chop that she had purchased from Dunnes Stores in Cornelscourt, Dublin, when she felt something hard as she was chewing the meat. Amy felt a sudden pain in her mouth, and removed the meat to find several shards of glass in the product.

Amy was immediately taken to St Colmcille’s Hospital in Loughlinstown to treat the cuts in her mouth. She was administered a tetanus shot, and an x-ray was taken of the area, which revealed no internal damage. However, Amy was advised to seek further medical treatment if she started to vomit. Although this did not happen, Amy proceeded to develop a very sore throat.

Amy sought legal counsel, and made an application for assessment of her claim to the Injuries Board. Dunnes Stores contested Amy’s allegations, resulting in the Injuries Board issuing Amy with an authorisation to pursue her claim for compensation through the court system.

As Amy was claiming the sum of €60,000 in compensation, the case was scheduled to be heard in the High Court. A short time prior to the start of the hearing, the court was informed that following negotiations between the two legal teams, the injury claim for shards of glass in a Dunnes sauce had been resolved. An undisclosed sum was awarded to Amy for her injuries without admission of liability from Dunnes Stores.
